I don't think Akira can "mistakenly think" that Gohan was in a certain form, especially seeing as how he's the creator of DBZ and controls the story. If he made Gohan be SSJ1 during the fight, then Gohan was SSJ1 during the fight.
If Gohan was SSJ1, then he was supposed to be SSJ1. Akira drew it like that, and Grega made very, very good points about the sparks. Simple as that, end of debate.
