Copyrighted things cannot be used at all without buying rights to it. It doesn't matter if you make a model based on Goku, it is still copyrighted even though you made the model from scratch. Even if the team didn't sell ESF, they still distributed it, and that is the thing that could've had them slapped with a C&D.

The whole thing about that is if you use copyrighted material, your best bet is to keep it to yourself, unless you buy rights for it, which might give you a go ahead on releasing it to the public.

Another thing... It's not Funimations fault, it's no ones fault, it is simply the law.
